Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) are an agreement between you and CamStats PRO LLC (“CamStats PRO”, “we”, “us”, or “our”). By creating an account or using CamStats PRO services, you agree to these Terms. If you do not agree, do not use the service.

You must be old enough to enter a binding contract where you live. If you are accepting these Terms for a company, school, agency or other organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

2. What CamStats PRO Provides

CamStats PRO produces geospatial viewshed analysis, mapping and visualisation for camera operators. We build your results from three things: the camera information you give us, public and third-party geographic data, and our own analytical methods and cartography. Coverage depends on the data available for your location.

3. Accuracy and Appropriate Use

CamStats PRO produces analytical estimates, not surveys. A viewshed is a model of what the terrain allows a camera to see, computed from public elevation and vegetation data, the camera information you give us, and any obstructions traced during calibration. Its accuracy depends on all of those, and on conditions that change after we run it.

Our methodology page sets out exactly what we model and what we do not, including the resolution of the data and the assumptions in the model. Please read it before relying on a result.

Our outputs are not a substitute for independent professional verification, and are not intended for:

• safety-critical decisions;
• legal, boundary or property determinations;
• privacy determinations;
• surveyed measurements;
• claims about whether a particular person, vehicle or object could be seen or identified;
• regulatory submissions that require surveyed accuracy.

4. Accounts and Your Responsibilities

You are responsible for keeping your account credentials confidential and for what happens through your account. For organisation accounts, the primary contact manages access. Tell us promptly if you believe your account has been used without your permission.

You are also responsible for the accuracy of the camera and site information you give us. The analysis is computed from it, so a wrong position, height or bearing produces a wrong result — which is not a defect in the service, and is corrected by fixing the information and reprocessing.

5. Payment, Renewal and Refunds

Payments are processed by Stripe. A Survey is a one-time purchase. A Live Survey is a recurring subscription.

Live Survey renews automatically at the end of each billing period — monthly or annually, whichever you chose — and keeps renewing until you cancel. You can cancel at any time from your dashboard, under Plan & Billing. Cancelling stops the next renewal; it does not end the period you have already paid for, and your hosted page stays up until that period ends.

Survey purchases are non-refundable once the deliverables have been generated. If we cannot produce what you paid for, or what we produce is materially defective and we cannot put it right in a reasonable time, we will refund you or agree another remedy — tell us and we will sort it out. Results that are wrong because the camera information supplied to us was wrong are corrected by reprocessing rather than refunded.

If a payment fails we may retry it, and we will tell you. Hosting may be suspended while an account is in arrears, as section 13 describes.

6. Your Content, and the Permission You Give Us

You own what you give us. Your camera details, your site information, and any artwork you upload — a trail map, slope map or site plan — remain yours. We claim no ownership of them.

To do the work, we need your permission to use them. You grant us a limited, non-exclusive licence to host, copy, process, adapt and display the material you submit, only as far as is necessary to operate the service and to produce and host your deliverables. That licence ends when the material does, except for copies retained in routine backups for a short period.

You confirm that you own the material you upload or otherwise have the right to give it to us for this purpose. That matters most for artwork: a trail map or site plan is often drawn by somebody else, and we have no way to know whether you hold the rights to it.

7. Ownership

We own the service that produces your results: the analysis engine, the cartography, the software, the designs, and the CamStats PRO name and marks. Nothing in these Terms transfers any of that to you.

What you may do with your deliverables. The maps, reports, downloads, hosted pages and overview maps we produce for you are yours to use for your own purposes, permanently and without further payment: publish them on your website, print them, put them in a brochure, hand them to your board, share them with your insurer or your planning authority. Formally, you have a perpetual, non-exclusive, worldwide licence to use, reproduce, display, publish and distribute them, subject to the attribution requirements in section 8.

That right does not end when a subscription does. What ends is hosting: a live page and its interactive 2D and 3D views are available while the hosting subscription is active. Everything you have downloaded, and everything in your dashboard, stays yours to use.

8. Map and Elevation Data

The maps we build for you draw on public and third-party datasets, and those datasets keep their own licences and attribution requirements. Each map displays the attribution its data source requires. That attribution must stay visible wherever the map is shown or published, and must not be removed, obscured or altered.

You may use, publish and distribute the finished deliverables you have bought, as section 7 describes. You may not separately extract the underlying map tiles, imagery or elevation data from them and redistribute, resell or publish those as datasets.

Elevation analysis is derived from public-domain United States federal data. Our methodology page names every source we use.

9. Data, Privacy and Retention

We use reasonable administrative, technical and organisational safeguards designed to protect the information you give us. No service can promise perfect security, and we do not.

We handle personal information and customer data as described in our Privacy Policy, including the service providers we use to operate CamStats PRO. That policy governs what we collect, why, and how long we keep it.

What you have paid for is yours. A Survey is a one-time purchase and does not expire. The maps, reports, description and downloads it produced remain available in your dashboard, and anything you have already downloaded is yours to keep and publish regardless of what happens to your account.

Hosting can be stopped at any time. When you pause a Live Survey camera, its live page stays up until the end of the period you have already paid for, and comes down when that period ends. Every map, report and download is kept, and resuming hosting brings the page back at the same address.

Inactive accounts. Your dashboard, and the maps, reports and downloads in it, stay available for 24 months from your last sign-in. If you do not sign in for that long we will email you twice — once at 21 months and again at 23 months, to the address on your account — and may then suspend access to the dashboard. We do this because we cannot undertake to keep serving an account nobody is using. Inactivity alone does not delete anything: your cameras, maps, reports and history are retained, and signing in restores access immediately and restarts the 24 months.

Deleting your account. You may ask us to delete your account at any time by contacting us. Deletion is handled as described in our Privacy Policy, which is where the timescales live. Deletion is not the same thing as inactivity: the paragraph above is about an account left alone, and this one is about an account you have asked us to remove.

10. What You May Not Do

Most of these restrictions exist to stop CamStats PRO being used to build a copy of CamStats PRO. They are not intended to limit ordinary use of your own deliverables, which section 7 describes. You agree not to:

• Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, models or methods behind the service, except where law expressly permits it.
• Trace, digitise, or otherwise derive or extract the viewsheds, coverage areas, terrain analysis or cartography from our maps and pages in order to reproduce them as data.
• Use the service, or anything it produces, to develop, train, evaluate or improve a product, dataset or machine-learning model that is a substitute for, substantially similar to, or competes with CamStats PRO.
• Access the service by automated means — scraping, crawling or bulk download — beyond ordinary use of your own account and pages, or in a way that places an unreasonable load on it.
• Remove, obscure or alter any attribution, credit or notice shown on a map or page.
• Resell, sublicense or redistribute the service itself, or provide it to third parties as a service of your own.
• Use the service unlawfully, or in a way that infringes anyone else’s rights.
• Upload or transmit malware, or attempt to gain unauthorised access to any account, server or system.
• Interfere with the service or with anyone else’s use of it.

If you want to do something these Terms appear to prevent — an integration, a research use, a reseller arrangement — ask us. Several of these have sensible answers that we would rather discuss than refuse.

11. Your Camera Is Your Responsibility

You are responsible for your camera: that it is lawfully installed and operated, that you have the right to publish its imagery and its location, and that your use of what we produce complies with the privacy, property and surveillance laws that apply to you. We build the analysis. We do not assess whether a camera is lawful, and nothing we produce should be read as advice that it is.

12. Service Availability and Changes

We maintain, update and improve CamStats PRO, and we may change or replace features, infrastructure, third-party providers and data sources. Some of what we rely on is outside our control: public elevation services, map tile providers and payment processing all have their own outages. We do not promise uninterrupted or error-free service, and no service level agreement applies unless we have agreed one with you in writing.

If we discontinue a feature you are paying for, we will tell you and deal with the affected part of your subscription fairly.

13. Suspension and Termination

We may suspend or terminate access where it is necessary: for non-payment, for a material breach of these Terms, for unlawful use, for a security threat, or to protect the service and other customers. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.

You may stop using CamStats PRO at any time, cancel a subscription from your dashboard, or ask us to delete your account.

If your access ends, hosted pages stop being served and any unpaid amounts remain due. What you have already downloaded remains yours under section 7, and the sections of these Terms that are meant to outlast the agreement — ownership, restrictions, disclaimers, liability and governing law — continue to apply.

We may update these Terms from time to time. The date at the top shows when the current version took effect. If a change is material we will tell you before it takes effect — through the service or by email to the address on your account — and continuing to use CamStats PRO after that date means you accept the updated Terms. Changes are not retroactive.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Erie County, New York, and you and we each consent to the jurisdiction of those courts.

Before filing anything, please contact us. Most disagreements are faster to fix than to litigate, and we would rather fix them.

18. General

If any part of these Terms is held unenforceable, the rest continues in force. Our not enforcing a provision on one occasion does not waive it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the service.
